Amber McLaughlin, The first openly transgender woman scheduled to be executed in the United States is pleading with Missouri Gov. Mike Parson for mercy, citing mental health issues. As of Monday morning, January 2, the online petition calling on Parson to stop the execution had gathered approximately 4,900 of the 6,400 signatures he needed.

McLaughlin is to be executed by injection on Tuesday, January 3, for the murder of a former girlfriend, Beverly Guenther, 45, on November 20, 2003. Guenther was stabbed to death in St Louis County after being raped. According to the Anti-Execution Death Penalty Information Center, there has never been a known case of the execution of an openly transgender prisoner in the United States.

On December 12, the attorneys filed an executive clemency petition with the governor, asking Parson to reduce McLaughlin’s sentence to life in prison and noting that she was not sentenced to death in a jury trial. According to the petition, Indiana and Missouri are the only two states in the United States that allow trial judges to impose death sentences in the event of a deadlocked jury, CBS News reported.

The clemency petition focuses on a number of concerns, including McLaughlin’s difficult background and her mental health issues, of which the jury was unaware during the trial. The leniency petition states that when she was a young child, her adoptive father wiped her face with her feces and her adoptive father used a Taser on her. She claims that she has a history of depression and has made several suicide attempts.

“It’s wrong when someone is executed anyway, but I hope this is the first time it hasn’t happened,” said federal public defender Larry Komp. “Amber has shown great courage in accepting who she is as a transgender woman despite the possibility that people will react with hate, so I admire her display of courage,” NBC News reported.

McLaughlin was in a relationship with Beverly Guenther before she transitioned. According to court documents, McLaughlin would appear at Guenther’s, 45-year-old’s, suburban St. Louis workplace, often hiding inside it. At times, police officers would escort Guenther to her vehicle after her work because of the restraining order she had received. When Guenther did not come home on the night of November 20, 2003, her neighbors alerted the police. Officers arrived at the office building and discovered a trail of blood and a broken knife handle near her car. A day later, McLaughlin directed police to the dump site of Guenther’s body in St Louis, near the Mississippi River. Guenther had been raped and stabbed to death in St Louis County, it was later discovered.

In 2006, McLaughlin was found guilty of first-degree murder. McLaughlin was sentenced to death by a judge after a jury deadlocked on the verdict. In 2016, a court ordered a new sentencing hearing, but in 2021, a federal appeals court panel imposed the death penalty. Furthermore, McLaughlin’s lawyers argued that Parson should spare his life due to the jury deadlock and McLaughlin’s remorse. Minutes later, she was pronounced dead. “I’m sorry for what I did,” McLaughlin said in a final written statement. “I’m a caring, caring person,” reports the Associated Press.
