Dr. Eric Andrew Salata, 54, of Naples, was charged on Nov. 21 with two counts of sexual assault on a physically defenseless person in the assaults on his 51-year-old and 73-year-old patients.
A Florida doctor accused of raping two sedated women while they underwent cosmetic medical procedures has been found dead in a ditch near his home, authorities said.
The physician’s practice, Pura Vida Medical Spa, focused on body contouring, skincare, and spa treatments.
Adam Horowitz, a lawyer for one of the victims, told the Daily Beast on Tuesday that Salata “escaped justice.”
“It is disappointing and frustrating that Dr. Salata has escaped justice,” Horowitz said in a statement. “It took tremendous courage for my client to tell the truth about him. She was ready to hold him accountable in court.”
He also told the Naples Daily News that when a criminal defendant dies suddenly, the case becomes a civil one.
Horowitz said he plans to file a civil case against Salata’s business and estate.
Dr. Eric Andrew Salata died at the age of 54 years old.
Cause of Death
On Tuesday, the Collier County Sheriff’s Office confirmed the suspected patient was found dead, the Naples Daily News reported.
An incident report cited by the Daily Beast says Salata’s body was found during a wellness check after his ankle monitor did not move for several hours on Monday.
After finding his boot sticking out in a local forest, police discovered the doctor’s body, with a gunshot wound to the head and a gun nearby, the news outlet reported.
Salata, who had practiced medicine for more than 30 years, left two notes, his credit cards, and her wedding ring at his home before his death, according to the report cited by Daily Beast.
Police stressed that his death has not yet been ruled a suicide because an autopsy has not been completed, but a spokesperson told the outlet that he “does not appear to be suspicious.”
Sheriff’s spokeswoman Michelle Batten did not release additional details about the death.
The 51-year-old woman told investigators that Salata administered laughing gas to her during a procedure last month when she felt him touch her private parts, according to a report obtained by the Naples Daily News. When she asked him about what she was doing, she stopped.
She then used more gas and offered her an unknown clear liquid, possibly tequila, to drink, causing her to become drunk and pass out.
She said that she later saw Salata performing oral sex on her and penetrating her.
The other woman also told police that Salata raped her during the proceedings.
Judge Michael Provost had set $100,000 bail for Salata, who posted cash bail to the courts and was released from jail on bond, the Naples Daily News reported.
